According to the social ontology proposed by John Searle, there are ontologically objective facts or “brute facts”, independent from human attitudes, and ontologically subjective facts. Among the latter, the most notable are institutional facts, such as money or borders, which existence is explained through a collective attribution of status function within a certain social context. Could “moral truths” exist according to an ontology like this? Assuming the truth as correspondence, the notion of “moral truth” remits to the notion of “moral (...) fact”. As we will see, these moral facts, contrary to what authors such as Markus Gabriel suggest, are similar to institutional facts. For this reason, the truth or falsity of moral statements will be, as indicated by authors such as Gilbert Harman, relative to a social context; without that being an obstacle for acknowledging their expressive and directive function. La polémica entre feminismo y transactivismo lleva tiempo ocupando titulares, artículos, debates, etc. En este trabajo se intentan clarificar algunos de los problemas conceptuales que subyacen al conflicto. Para empezar, se abordan los conceptos de «sexo», «género» e «identidad de género» a partir del aparato conceptual proveniente de la ontología social presentada por John Searle. A continuación, ante la conveniencia de disponer de términos para hacer referencia unívoca a las personas de un sexo y de otro, se contrastan diferentes sentidos (...) de «mujer». La discusión de estas nociones permitirá abordar la cuestión política de fondo de si las categorías de género son un instrumento de opresión que abolir o, por el contrario, una identidad que reivindicar; así como una cuestión de cariz más jurídico como para qué deben servir las categorías «hombre» y «mujer» consignadas en leyes y documentos oficiales. This paper takes as starting point the relative indeterminateness of current legal systems. This circumstance determines from the point of view of judicial activity a substantial freedom for judges, which translates into the existence of different interpretive possibilities. For this reason the role of argumentationin judicial activity has been reinforced, but at the same time the question arises of how to control the judges and what kind of responsibility they have in exercising their functions.

This research uses a survey to analyze types of benefits sought by partners in cross-sector collaborations in Spain and to test and build upon theories that indicate prior collaboration experience and partner alignment will positively affect value creation through the collaboration. Using exploratory factor analysis to operationalize a broad range of potential benefits into more specific concepts, the results of this study identify distinct factors that characterize the types of benefits sought by non-profit organizations and businesses engaged in cross-sector collaborations. (...) Findings show that prior experience and alignment positively affect each factor for value creation. Prior experience is also found to influence the type of benefits sought from cross-sector collaborations and to positively affect alignment in terms of mission and strategy. Various international authorities have insisted on the importance of ethical learning in higher education for would-be professionals, including students of Business Administration. As the process of creating the European Higher Education Area gathers pace, first steps have been taken to explicitly incorporate ethics in the common European Qualifications Framework. However, the authors of this study show how in the course of the EQF development process, the consideration given to ethical qualifications has been curtailed and subjected to serious limitations. In this (...) article, the authors review the historical development and the main elements of the EQF. Then, they analyze the gradual elimination of ethics within the EQF. Background: Frailty is a common syndrome among older adults and patients with several comorbidities. Grip strength is a representative parameter of frailty because it is a valid indicator of current and long-term physical conditions in the general population and patients with severe mental illnesses. Physical and cognitive capacities of people with SMIs are usually impaired; however, their relationship with frailty or social functioning have not been studied to date. The current study aimed to determine if GS is a valid predictor (...) of changes in cognitive performance and social functioning in patients with type-2 diabetes mellitus and SMIs. Methods: Assessments of social functioning, cognitive performance, and GS were conducted in 30 outpatients with type 2 diabetes mellitus, 35 with major depressive disorder, 42 with bipolar disorder, 30 with schizophrenia, and 28 healthy controls, twice during 1-year, follow-up period. Descriptive analyses were conducted using a one-way analysis of variance for continuous variables and the chi-squared test for categorical variables. Differences between groups for the motor, cognitive, and social variables at T1 and T2 were assessed using a one-way analysis of covariance, with sex and age as co-variates. To test the predictive capacity of GS at baseline to explain the variance in cognitive performance and social functioning at T2, a linear regression analysis was performed. Results: Predictive relationships were found among GS when implicated with clinical, cognitive, and social variables. These relationships explained changes in cognitive performance after one year of follow-up; the variability percentage was 67.7%, in patients with type-2 diabetes mellitus and 89.1% in patients with schizophrenia. Baseline GS along with other variables, also predicted changes in social functioning in major depressive disorder, bipolar disorder, and schizophrenia, with variability percentages of 67.3, 36, and 59%, respectively. Conclusion: GS combined with other variables significantly predicted changes in cognitive performance and social functioning in people with SMIs or type-2 diabetes mellitus. Interventions aimed to improve the overall physical conditions of patients who have poor GS could be a therapeutic option that confers positive effects on cognitive performance and social functioning. La presente obra está destinada a estudiar la incidencia de la sistematización y secuenciación procedimental en el desarrollo discente. Propone una mejora cualitativa en la adquisición de conocimientos teóricos y prácticos, así como en la capacitación del pensamiento crítico, del juicio razonado y de la sensibilidad moral en el ámbito de la Teoría de la Educación. Se presenta como un proceso segmentado, es decir, como una progresión o secuencia de pasos que se orienta a una tarea final consistente en intentar (...) poner a prueba si el citado proceso resulta eficiente en su orden. Así, pues, esta larga tarea o flujo de trabajo se propone investigar si la acción pedagógica estructurada y secuenciada resulta globalmente más segura, fructífera y vigorosa que las acciones complejas puntuales por lo que se refiere al logro y consolidación de determinadas capacidades. De lo que se trata es de estudiar la validez de una metodología procesual que evite convertir las asignaturas en compartimentos estancos por lo que se refiere a las competencias y a las capacidades discentes, y comprobar si la secuenciación temático-procedimental propuesta supone una mejora apreciable en la calidad de la docencia, así como un beneficio presente y futuro para los estudiantes, que son sus verdaderos destinatarios. En 1976 —siendo yo un jovencísimo inmigrante, prácticamente recién llegado de mi país—, en el populoso downtown de Los Ángeles, me encontré con un disco de larga duración del cantautor catalán Joan Manuel Serrat. El disco en mención musicalizaba varios poemas del malogrado poeta Miguel Hernández y un poema de Miguel de Unamuno. De regreso a mi apartamento de soltero, puse el disco y de inmediato quedé impactado por la belleza de las interpretaciones. Recuerdo que una de ellas, (...) Following an extensive review of the moral intensity literature, this article reports the findings of two studies (one between-subjects, the other within-subject) that examined the effect of manipulated and perceived moral intensity on ethical judgment. In the between-subjects study participants judged actions taken in manipulated high moral intensity scenarios to be more unethical than the same actions taken in manipulated low moral intensity scenarios. Findings were mixed for the effect of perceived moral intensity. Both probable magnitude of consequences (a factor (...) consisting of magnitude of consequences, probability of effect, and temporal immediacy) and social consensus had a significant effect; proximity did not. In the within-subject study manipulated moral intensity had a significant effect on ethical judgment, but perceived moral intensity did not. Regression of ethical judgment on age, gender, major, and the three perceived moral intensity factors was significant between-subjects, but not within-subject. Ethical judgment was found to be a more robust predictor of intention than perceived moral intensity using a within-subject design. (shrink)

In mid-twentieth-century Mexican philosophy, there was a peculiar nationalist existentialist project focused on the cultural conditions of agency. This article revisits some of those ideas, including the idea that there is an important but underappreciated experience of one's relationship to norms and social meanings. This experience—something called accidentality—casts new light on various forms of social subordination and socially scaffolded agency, including cultural alienation, biculturality, and double consciousness.

Naturalistic explanations (of linguistic behaviour) have to answer two questions: What is meant by giving a naturalistic explanation, and what does it explain after all? Two kinds of descriptivism present in Wittgenstein´s work are distinguished and applied to Hirsch´s “division problem”. They answer the two questions raised and keeping in mind their distinction is important to assess naturalistic explanations.

In 1991, Jones developed an issue-contingent model of ethical decision making in which moral intensity is posited to affect the four stages of Rest's 1986 model. Jones claimed that moral intensity, which is "the extent of issue-related moral imperative in a situation", consists of six characteristics: magnitude of consequences, social consensus, probability of effect, temporal immediacy, proximity, and concentration of effect. This article reports the findings of two studies that analyzed the factor structure of moral intensity, operationalized by a 12-item (...) Perceived Moral Intensity Scale adapted from the work of Sing-hapakdi et al. [1996, Journal of Business Research, 36, 245-255] and Frey [2000, Journal of Business Ethics, 26, 181-195]. The two items that were purported to measure CE were dropped due to their inability to effectively tap into the characteristic proposed by Jones. Factor analyses of the remaining 10 items supported a 3-factor structure, with the MC, PE, and TI items loading on the first factor, the PX items loading on the second factor, and the SC items loading on the third factor. These factors were labeled: Probable Magnitude of Consequences, Proximity, and Social Consensus. The authors conclude that moral intensity consists of three characteristics, rather than the six posited by Jones. (shrink)

También, se ha generado preocupación sobre sus implicaciones éticas, debido a (...) que la inteligencia artificial consiste en sistemas no autónomos que no son capaces de actos libres y responsables, lo cual exige que sean guiados por personas. Por tanto, el presente trabajo tiene como objeto presentar algunos fundamentos de la filosofía realista de santo Tomás de Aquino que nos permitan hacer una valoración de la inteligencia artificial. After the publication of Begriffsschrift, a conflict erupted between Frege and Schröder regarding their respective logical systems which emerged around the Leibnizian notions of lingua characterica and calculus ratiocinator. Both of them claimed their own logic to be a better realisation of Leibniz’s ideal language and considered the rival system a mere calculus ratiocinator. Inspired by this polemic, van Heijenoort (1967b) distinguished two conceptions of logic—logic as language and logic as calculus—and presented them as opposing views, but did not explain (...) Frege’s and Schröder’s conceptions of the fulfilment of Leibniz’s scientific ideal. -/- In this paper I explain the reasons for Frege’s and Schröder’s mutual accusations of having created a mere calculus ratiocinator. On the one hand, Schröder’s construction of the algebra of relatives fits with a project for the reduction of any mathematical concept to the notion of relative. From this stance I argue that he deemed the formal system of Begriffsschrift incapable of such a reduction. On the other hand, first I argue that Frege took Boolean logic to be an abstract logical theory inadequate for the rendering of specific content; then I claim that the language of Begriffsschrift did not constitute a complete lingua characterica by itself, more being seen by Frege as a tool that could be applied to scientific disciplines. Accordingly, I argue that Frege’s project of constructing a lingua characterica was not tied to his later logicist programme. (shrink)

With their book Logical Pluralism, Jc Beall and Greg Restall have elaborated on their previous statements on logical pluralism. Their view of logical pluralism is centred on ways of understanding logical consequence. The essay tries to come to grips with their doctrine of logical pluralism by highlighting some points that might be made clearer, and questioning the force of some of Beall’s and Restall’s central arguments. In that connection seven problems for their approach are put forth: (1) The Informal Common (...) Core Problem, (2) The Formal Common Core Problem, (3) The Superior Judge Problem, (4) The Problem of the Conditional, (6) The Problem of an Unsettled Concept of Consequence, (7) The Methodological Problem, (8) The General Logical Form Problem. It seems that the case for logical pluralism is far from clear. It is even unclear what exactly logical pluralism is and where is stops. It is also unclear if logical pluralism could be stated as it is, if it were true. So far universalism seems to be the better position to take. (shrink)

In the present work I am interested in addressing a specific aspect within the conceptual problem that poena naturalis implies. In other words, here I will answer the question about what is the poena naturalis. We can be recognized three theories: one that affirms that the poena naturalis is a compensation for culpability, another according to which the poena naturalis is the product of clemency or compassion, and the last that defends that the principles of legality, proportionality and rationality allow (...) justifying the poena naturalis. I will stop at each one of them in order to carry out a critical examination that will allow me to conclude which is the conception that best supports natural punishment. (shrink)
